Data Protection Notice for Data Subjects of our Clients
You are contacting fox-on Datenschutz GmbH because you have received our contact details from a company that has appointed fox-on as its data protection officer – for example, because you have a question about how your personal data is processed or you want to exercise your data protection rights?
Notice:
Data Protection Notices from fox-on on other matters can be found here the data protection overview page.
This notice serves to inform you about how we process your data:
fox-on is appointed as an external company data protection officer by other companies. For this reason, these companies publish our contact details, and we are available as a point of contact for you as a data subject in order to support the company in complying with their data protection obligations and implementing the rights of data subjects. The position and tasks of fox-on as data protection officer are determined by the EU General Data Protection Regulation (Art. 38 and Art. 39 GDPR).
fox-on processes your personal data on the legal basis of legal obligations (Art. 6 Para. 1 Letter c GDPR). These consist of being able to fulfil our role as data protection officer.
In individual cases, the legitimate interests of us or our client may also be decisive (Art. 6 Para. 1 Letter f GDPR) so that we can provide our consulting services to them.
In addition, your consent may also constitute a legal basis (Art. 6 Para. 1 Letter a GDPR), in particular if you have voluntarily provided us with data that goes beyond what is necessary for the respective processing.
We usually receive information about you from you.
Exceptionally, we may also receive such data from companies that we support (for example, if you have contacted the company directly with your enquiry and our contacts then call us in for advice). As a rule, this is then your contact data and information on the data protection issue on which fox-on is providing advice.
Your personal data is not shared with other parties unless you have given your consent, or this is required by law.
Such exceptions may exist in particular for the company or group of companies we consult or for the service providers who provide or maintain our IT infrastructure.
Personal data is stored for as long as it is required for the above-mentioned purposes and for as long as statutory retention periods require.
As a data subject, you have the following rights, provided that the legal requirements are met
- Right of access, Art. 15 GDPR
- Right to rectification, Art. 16 GDPR
- Right to erasure, Art. 17 GDPR
- Right to restriction of processing, Art. 18 GDPR
- Right to data portability, Art. 20 GDPR
- Right to object, Art. 21 GDPR
If the processing is based on your consent, you have the right to revoke your consent in whole or in part at any time with effect for the future.
If the data processing is based on legitimate interests, you have the right to object to this data processing. There must be legitimate reasons for this arising from your particular situation.
You also have the right to lodge a complaint with the data protection supervisory authority about data processing. Of course, we would be pleased if you would contact us first.
You are not obliged to provide us with any data. However, if you do not wish to do so, we may not be able to fully assist you in exercising your data protection rights.
