Data Protection Notice for Participants in Video Calls using Microsoft Teams

We are happy to get in touch with you. When conducting video conferences initiated by fox-on, data about the participants is processed. We would like to inform you about this here:

Purpose of the data processing

fox-on processes your personal data in order to organize and conduct video conferences and online meetings using the “Microsoft Teams” software. Teams is a service provided by Microsoft.

Scope and legal basis

For planning video conferences, we process in particular your e-mail address and your name. We have received this data from you or, if applicable, from your employer or client.

For the execution of video conferences, we also process audio, video and text data (in particular for the transmission of images and sound, and possibly also text/chat messages) as well as metadata about the meeting (e.g., date, time, meeting ID, participants, telephone numbers, location).

This data processing is necessary for us to conclude or execute the contract with your employer or client. In other cases, it is necessary in order to be able to present our services to you (this is in our legitimate interest in the scope of Art. 6 Para. 1 Letter f GDPR).

Your image is processed when you turn on your camera. Whether you do so is, of course, your free decision (even though we like to see who we are talking to and usually also transmit our own video).

We do not record our online meetings. If this should happen in exceptional cases (e.g., during a data protection training at the request of our customer in order to make the recording available to other colleagues at a later date), we will give you an explicit notice beforehand: You would then have the opportunity to leave the video conference or to switch off your own video and/or audio transmission.

Recipients

Personal data in connection with video conferences is not normally disclosed to third parties. An exception exists if the data is intended precisely for disclosure, which may be the case depending on the content of the video conference.

In addition, the operator Microsoft also receives knowledge of the data, insofar as this is provided for in the context of the data processing agreement with Microsoft. The data processing takes place on data centres within the European Union. In the cases where Microsoft transfers personal data to the USA for further processing, the Microsoft companies have, according to their own statements, concluded EU standard contracts to protect the data.

Storage period

The personal data will be stored for as long as they are required for the above-mentioned purposes.

Your rights as a data subject

As a data subject you are entitled to the following rights, provided that the legal requirements are fulfilled:

  • Right to be informed, Art. 15 GDPR
  • Right to rectification, Art. 16 GDPR
  • Right to erasure, Art. 17 GDPR
  • Right to restriction of processing, Art. 18 GDPR
  • Right to data portability, Art. 20 GDPR
  • Right to object, Art. 21 GDPR

Insofar as the processing is based on your consent, you have the right to revoke your consent to the processing of the data at any time with effect for the future.

Insofar as the data processing is based on a balancing of legitimate interests, you have the right to object to this processing of the data. There must be legitimate reasons for this, which arise from your particular situation.

You also have the right to lodge a complaint with the data protection supervisory authority about the data processing. We would be pleased if, in case of doubt, you would contact us first.
